ITEM TWO ON THIS EVENING'S AGENDA IS THE REQUEST FOR A CONDITIONAL USE PERMIT TO ADD OUTDOOR VEHICLE DISPLAY IN SALES TO AN EXISTING VEHICLE REPAIR FACILITY WITH INDOOR SALES.

NO CHANGES TO THE BUILDING OR SITE IMPROVEMENTS ARE PROPOSED.

THE SUBJECT OF THE APPLICATION IS 10 62 NORTH SECOND STREET, WHICH IS LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF NORTH SECOND STREET AND SUMNER AVENUE.

THE SITE IS ROUGHLY TWO THIRDS OF AN ACRE AND IS SITUATED AT THE CITY'S BOUNDARY WITH THE COUNTY OF SAN DIEGO.

THE PROPERTY IS SURROUNDED BY A MIX OF COMMERCIAL USES, FRONTING NORTH SECOND STREET AND VARIOUS RESIDENTIAL USES GENERALLY TO THE WEST.

THE PROPERTY IS DESIGNATED GENERAL COMMERCIAL AND HAS A CONSISTENT GENERAL COMMERCIAL ZONING DESIGNATION.

THE EXISTING BUILDING WAS ORIGINALLY CONSTRUCTED IN 1960 AS A POST OFFICE AND IS APPROXIMATELY 4,600 SQUARE FEET WITH A CENTRAL PRIMARY WORK AREA ACCESSED BY ROLL-UP DOORS.

IN 2003, CONDITIONAL USE PERMIT NUMBER 1939 WAS GRANTED AUTHORIZING SALES AND REPAIR OF GENERATORS AND APPLIANCES FOR RECREATIONAL VEHICLES AS A LIMITED AUTOMOTIVE REPAIR USE SUBJECT TO CONDITIONS TO ENSURE COMPATIBILITY.

IN 2023, THE COMMUNITY DEVELOPMENT DEPARTMENT APPROVED MINOR AMENDMENT NUMBER 20 23 0 0 0 1 WITH ADDITIONAL CONDITIONS.

THE MINOR AMENDMENT ADDED REPAIR SERVICES FOR POWERSPORT VEHICLES LIKE ATVS, UTVS, AND MOTORCYCLES, AS WELL AS NEW PARTS AND ACCESSORY SALES TO CONDITIONAL USE.

PERMIT NUMBER 1939 AS CONSISTENT AUTOMOTIVE SERVICE AND REPAIR USES LATER THAT SAME YEAR, ORDINANCE NUMBER 51 36 WAS ADOPTED AND ADDED INDOOR ONLY SALES OF NEW AUTOMOBILE AS A PERMITTED USE IN THE GENERAL COMMERCIAL ZONE.

THE COMMERCIAL USE REGULATIONS, HOWEVER, OTHERWISE REQUIRE A CONDITIONAL USE PERMIT FOR AUTO SALES AND THUS IT IS NECESSARY WITH OUTDOOR VEHICLE INVENTORY OR SALES DISPLAYS TO OBTAIN A CONDITIONAL USE PERMIT.

THE SUBJECT CUP APPLICATION PROPOSES TO ADD OUTDOOR DISPLAY AND SALES OF POWERSPORT VEHICLES TO THE REPAIR USES AUTHORIZED BY CONDITIONAL USE PERMIT NUMBER 1939 AS AMENDED AND THE INDOOR SALES PERMITTED BY ZONING CODE.

NO ALTERATIONS TO THE EXISTING BUILDING OR SITE.

IMPROVEMENTS ARE PROPOSED AS DISPLAY IS CONFINED TO EXISTING PAVED AREAS.

THE PROJECT SITE PLAN REFLECTS THE PROPOSED SITE CONDITION.

NOTABLE EXISTING FEATURES INCLUDE THE EXISTING SIX FOOT MASONRY BOUNDARY WALL ALONG THE WESTERLY AND SOUTHERLY PROPERTY LINES, A TRASH ENCLOSURE, AS WELL AS EXISTING LANDSCAPE PLANNERS WITH MATURE TREES ALONG THE STREET.

FRONTAGES.

EXISTING GATES OFF SUMNER AVENUE PROVIDE ACCESS TO 11 PARKING STALLS, WHICH CAN BE FOUND SUFFICIENT FOR THE ANTICIPATED DEMAND OF THE BUSINESS AND ITS CUSTOMERS WITH THE CONDITIONAL USE PERMIT.

A PROPOSED CONDITION IS INCLUDED TO ENSURE THAT THE SITE MAINTAINS ADEQUATE PARKING AND THAT NO EMPLOYEES PARK ON ADJACENT RESIDENTIAL STREETS.

THE PRIMARY VEHICLE DISPLAY AREA IS LOCATED IN THE EXISTING PARKING AREA AT THE NORTHEAST CORNER NEAR THE INTERSECTION OF NORTH SECOND STREET AND SUMNER AVENUE.

A SECONDARY DISPLAY IS PROPOSED SOUTH OF THE BUILDING ENTRANCE OFF NORTH SECOND STREET ON THE EXISTING PAVING BEHIND THE PLANTER CONSISTENT WITH MUNICIPAL CODE REQUIREMENTS.

THESE OUTDOOR DISPLAY AREAS DO NOT DISPLACE FOR REQUIRED PARKING NOR LANDSCAPE IMPROVEMENTS.

A PROPOSED CONDITION OF OF APPROVAL LIMITS DISPLAY TO THE IDENTIFIED AREAS TO ENSURE THAT PARKING AREAS DRY VILES AND LANDSCAPE AREAS ARE NOT FURTHER DIMINISHED.

THE PROPOSED AUTOMOBILE DEALERSHIP RESULTING FROM THE ADDITION OF OUTDOOR DISPLAY AND SALES IS CATEGORICALLY EXEMPT FROM THE REVIEW.

REVIEW REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

PURSUANT TO THE EXEMPTION FOR EXISTING FACILITIES REQUIRED FINDINGS TO GRANT, THE CONDITIONAL USE PERMIT CAN BE MADE IN THE AFFIRMATIVE.

THE PROPOSED USE IS CONSISTENT WITH GENERAL PLAN GOAL NUMBER NINE AND ITS POLICIES RELATED TO FOSTERING EXPANSION OF SUCCESSFUL LOCAL BUSINESSES AND REALIZING A COMPETITIVE COMMERCIAL BASE, EXISTING OPERATIONS HAVE NOT RESULTED IN CODE COMPLIANCE COMPLAINTS.

FURTHER ADAPTED CONDITIONS FROM OF APPROVAL FROM THE PRIOR USE PERMIT ARE INCORPORATED AND SUPPLEMENTAL CONDITIONS WILL ENSURE ONGOING COMPATIBILITY WITH SURROUNDING PROPERTIES.

UM, AFTER THEY, UM, STARTED WORKING ON THE SITE, UH, THEY DETERMINED THAT THE FEASIBILITY OF RETAINING SOME OF THE BUILDINGS, UM, WASN'T GOING TO WORK.

SO THEY DEMOLISHED, UH, SEVERAL OF THE BUILDINGS, UM, WHERE THEY WERE GONNA HAVE THE BATTERIES INSIDE THE BUILDINGS.

AND THEN THEY, UH, MADE SOME REFINEMENTS TO THE FIRE LANE ACCESS THAT WENT THROUGH THE SITE.

AND THAT'S THE SIDE THAT'S ON THE, JUST NORTH OF THE SCHOOL, CORRECT? NORTH OF THE SCHOOL AND SOUTH OF JEROME'S? YEAH.

AND THEN THE OTHER QUESTION I HAD WAS ON THE PETE'S RESTAURANT AND ALCOHOL SERVICE THAT MOVED TO AN ADJACENT SUITE , UM, I THINK I KNOW WHERE THIS IS.

UH, IT'S ACROSS FROM, UH, ACROSS FROM OUTBACK STEAKHOUSE.

IS THAT ABOUT WHERE IT IS? UH, JUST YES.

GENERALLY SPEAKING.

SO THEY WERE, UH, IN AN EXISTING RESTAURANT, THEY HAD GOTTEN A CONDITIONAL USE PERMIT THAT WAS APPROVED FOR THE ALCOHOL SALES AND THEY NEEDED TO RELOCATE INTO A DIFFERENT TENANT SPACE THAT WAS SUBSTANTIALLY SIMILAR IN SIZE AND SCOPE.

AND SO WE PROCESSED THAT, UH, WITH A MINOR AMENDMENT.

UH, THE MINOR AMENDMENT MEANS THAT WE PROVIDE NOTICE TO THE SURROUNDING PROPERTY OWNERS AND WITH THE ABILITY TO APPEAL THAT TO THE PLANNING COMMISSION IF THEY HAD ANY CONCERNS.

UH, WE DIDN'T RECEIVE ANY RESPONSES.

SO THE DETERMINATION BY THE DIRECTOR WAS FINAL.

YEAH.

SO IT'S ESSENTIALLY JUST A ONE SPACE TO THE NEXT SPACE.

YES.

IT'S NOT MOVING TO A NEW LOCATION ALTOGETHER.
