SO THE PROPOSED, UH, ZONING CODE UPDATE IS PRIMARILY RELATED TO HOUSING AND COMMERCIAL LAND USES, UM, AS WELL AS SOME RECENTLY IMPROVED AND ENACTED STATE LAWS.
UM, THE FIRST SET OF UPDATES, UH, ADDRESS COMMENTS RECEIVED FROM THE STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT.
UH, THAT'S MOSTLY REGARDING, UH, PREVIOUS UPDATES TO THE ACCESSORY DWELLING UNIT REGULATIONS.
UH, THE NEXT TWO ITEMS WERE DIRECTED BY THE CITY COUNCIL IN MARCH, AND THOSE INCLUDE THE EMERGENCY HOUSING REGULATIONS AS WELL AS COMMERCIAL REGULATIONS FOR HOSPITALS.
AND THEN THE LAST CATEGORY IS FOR, UH, PUBLIC HEARING PROCEDURES, WHICH IS ALSO, UH, BASED ON, UH, STATE LAW FOR PERMIT STREAMLINING.

SO THE ACCESSORY DWELLING UNIT CHANGES INCLUDE UPDATING REFERENCES TO THE GOVERNMENT CODE, UH, BASED ON THOSE RECENTLY ENACTED STATE LAWS.WE'RE ALSO CLARIFYING, UH, PARKING EXCEPTION FOR NEW CONSTRUCTION.
AND THEN CONFIRMING THAT THE CONSTRUCTION OF AN A DU, UH, WITH FIRE SPRINKLERS DOES NOT TRIGGER A REQUIREMENT FOR FIRE SPRINKLERS IN THE PRIMARY DWELLING.
THOSE ARE ALL COMMENTS THAT WE GOT BACK FROM STATE HCD BASED ON OUR, OUR EXISTING CODE.
UM, OUR EXISTING CODE INCLUDES A LOT OF THOSE REQUIREMENTS.
THEY, UH, JUST WANTED US TO MAKE SOME CHANGES TO THE WORDING AND, AND COMMAS AND OTHER, UM, SEMANTIC TYPE ISSUES.
UM, OTHER UPDATES, UH, CLARIFY THE MAXIMUM HEIGHT FOR ATTACHED ADUS OUTSIDE OF THE SETBACKS FOR THE PRIMARY DWELLING, AND CONFIRM THAT ATTACHED GARAGES ARE CONSIDERED PART OF THE EXISTING SINGLE FAMILY, UH, RESIDENCE FOR THE PURPOSE OF CREATING A JUNIOR ACCESSORY DWELLING UNIT.
AGAIN, SAME THING WHERE THAT'S THE CODE THAT WE'VE BEEN, UM, IMPLEMENTING.
UM, SO THERE'S REALLY NO CHANGES.
THEY JUST WANTED US TO ADD SOME CLARIFYING LANGUAGE IN ORDER TO BE MORE CONSISTENT WITH STATE LAW IN THEIR INTERPRETATION.
UM, THE EXISTING EMERGENCY HOUSING PROGRAM, UH, CURRENTLY ALLOWS UP TO SIX EMERGENCY HOUSING UNITS ON LARGE PROPERTIES, UH, WITH THE APPROVAL OF AN ADMINISTRATIVE ZONING PERMIT.
UH, THE PROPOSED CHANGES IS DIRECTED BY THE CITY COUNCIL OR TO, UH, ALLOW, UM, EXISTING OPERATIONS WITH SIX UNITS THAT HAVE BEEN OPERATING WITHOUT ANY CODE COMPLIANCE ISSUES OR COMPLAINTS, UH, OR SUBSTANTIATED COMPLAINTS, I SHOULD SAY, UM, TO ADD UP TO TWO ADDITIONAL UNITS, UM, AFTER OPERATING FOR A YEAR.
AND THEN IF THEY CONTINUE TO SUCCESSFULLY OPERATE WITH EIGHT UNITS FOR A YEAR, THEY COULD INCREASE BY TWO MORE FOR A TOTAL OF UP TO 10 UNITS.
UM, JUST AS A REMINDER, THERE'S CURRENTLY ONLY, UH, ONE OPERATING EMERGENCY HOUSING PROGRAM THAT'S AT SIX 60, UH, SOUTH THIRD STREET AT THE MERIDIAN CHURCH.
UM, THEN FOR COMMERCIAL LAND USES, THE COMMERCIAL LAND USE TABLE CURRENTLY ALLOWS FOR HOSPITALS IN THE OFFICE PROFESSIONAL ZONE AS WELL AS THE NEIGHBORHOOD COMMERCIAL ZONE.
AND THAT'S WITH THE APPROVAL OF THE CONDITIONAL USE PERMIT.
SO THE GENERAL PLAN INDICATES THAT THESE AREAS FOR THE CN ZONE, THE NEIGHBORHOOD COMMERCIAL ZONE AND OFFICE PROFESSIONAL ZONES ARE TYPICALLY IN CLOSE PROXIMITY TO RESIDENTIAL AREAS.
SO IN GENERAL, SUITABLE LAND USES IN CLOSE PROXIMITY TO RESIDENTIAL, UM, DON'T OPERATE ON A 24 HOUR BASIS.
THEY'RE REALLY INTENDED TO OPERATE DURING, UH, MORE NORMAL BUSINESS HOURS.
SO THINKING ABOUT THIS, UM, AND THINKING ABOUT A HOSPITAL OPERATING ON A 24 HOUR BASIS IN CLOSE PROXIMITY TO RESIDENTIAL, UH, STAFF BROUGHT FORWARD, UH, BASED ON THE COUNCIL'S DIRECTION, AN UPDATE TO THE LAND USE TABLE TO SAY THAT, UH, THEY WOULD NO LONGER BE ALLOWED THROUGH A CONDITIONAL USE PERMIT AND THEY WOULDN'T BE PERMITTED IN THOSE ZONES FOR HOSPITALS.
AND THEN THE LAST ITEM, UH, IS AN UPDATE TO CREATE A NEW PROCEDURE TO ALLOW THE CITY COUNCIL TO CALL UP A CONTINUED PUBLIC HEARING, UH, TO THE CITY COUNCIL.
UM, THIS IS SOMEWHAT RELATED TO CHANGES IN STATE LAW RELATED TO HOUSING.
THERE'S, UM, NEW STATE LAW THAT SAYS YOU CAN'T HAVE MORE THAN FIVE PUBLIC HEARINGS FOR A HOUSING PROJECT.
IT WAS IN SOME JURISDICTIONS THAT WERE HAVING HOUSING PROJECTS THAT WERE BEING CONTINUED, OR THE PLANNING COMMISSIONER, CITY COUNCIL WERE ASKING FOR, YOU KNOW, NEW INFORMATION OR CHANGES TO THE PROJECT.
AND SO THE, UH, AT THE STATE LEVEL, THEY PASSED A LAW SAYING YOU CAN'T HAVE MORE THAN FIVE PUBLIC HEARINGS OR MEETINGS ON A SINGLE, UM, TOPIC.
AND SO, UH, IN ORDER TO ENSURE THAT THE CITY COUNCIL WOULD HAVE THE ABILITY TO CALL UP, UH, SOMETHING THAT'S BEEN CONTINUED, THE CHANGE TO THE CODE WOULD THEN ALLOW THEM TO, IF SOMETHING WAS BEING CONTINUED OR THEY WANTED COUNCIL WANTED TO ACT ON IT IMMEDIATELY A COUNCIL MEMBER COULD CALL THAT ITEM UP.
AND SO THAT'S WHAT THAT LAST CHANGE WOULD ACCOMPLISH.
