WE CALL UPON ALL THE RESIDENTS TO RECOGNIZE THE VITAL ROLE GERMAN AMERICANS HAVE PLAYED IN THE DEVELOPMENT OF OUR CITY AND NATION.

AND FURTHERMORE, EXPRESS OUR APPRECIATION FOR PROMOTING TRADITIONAL GERMAN CULTURE WITH LIVE MUSIC FOLK DANCES, GAMES, AND CONTESTS AT THE ANNUAL OCTOBER FEST IN EL CAJON.

PLEASE JOIN US IN CELEBRATING THE 51ST ANNIVERSARY OF THE EL CAJON CLUBHOUSE.

UH, IT STARTS, UH, IT'S TWO WEEKENDS THIS WEEKEND, THE 29TH AND 30TH OF SEPTEMBER THROUGH OCTOBER 1ST AND OCTOBER 6TH THROUGH EIGHTH NEXT WEEKEND.

AND, UM, YEAH, IT'S, UH, WE HAVE OUR BANDS.

I, THEY'RE ALREADY STARTING TO FLY IN FROM GERMANY.

I'VE BEEN GETTING ON FACEBOOK THAT AS THEY'RE BOARDING THE PLANES FROM, UH, UH, MUNICH OR FRANKFURT, ONE OR THE OTHER.

UM, SO THAT'S, THAT'S COMING UP.

WE'RE WE'RE, UH, SUPPOSED TO GET THE KEGS OF BEER TOMORROW.

WE WERE BEEN OUT DOWN THERE WITH WORK PARTIES ALL WEEKEND, SETTING UP THE TENTS AND THE, UH, THE BOOTHS.

WELL, NOW YOU MENTIONED THAT WE COULD NOT DO IT WITHOUT OUR VOLUNTEERS AND, YOU KNOW, TO REALLY SUPPORT THE CLUB AND KEEP THE PRICES DOWN, BECAUSE AGAIN, WE HAVE TO PAY FOR THE VAN AND MC AND STUFF LIKE THAT.

BUT ALSO, UM, I MEAN, THERE'S JUST REALLY LITERALLY HUNDREDS OF VOLUNTEERS THAT COME UP WITH ALL THESE DIFFERENT POSITIONS.

WE'VE HAD, LIKE I SAID, WORK PARTIES AND THROUGHOUT THE DAY, ALL THESE VOLUNTEERS WORK THREE HOUR SHIFTS FOR THE MOST PART.

AND, UH, AS LONG AS THEY'RE HAVING FUN, IT, IT, IT'S, IT, UH, YOU KNOW, IT SPREADS TO THE, TO THE CUSTOMERS AND EVERYTHING.

SO WE'RE PRETTY PROUD OF THAT.

JUST, UH, MY NAME AS WE SAID IS TAYLOR ABIEL, AND I'M A RESIDENT OF LUKE LANE HERE IN EL CAJON.

UH, BEFORE I, AGAIN, ALLOW ME FIRST JUST TO RECOGNIZE AND EXPRESS MY HEARTFELT APPRECIATION FOR ALL THE DEDICATED WORK THAT YOU MEMBERS OF THE COUNCIL HAVE UNDERTAKEN TO ENHANCE AND IMPROVE OUR CITY.

UH, IT'S EVIDENT THAT THE COUNCIL IS COMMITTED TO THE BETTERMENT OF OUR COMMUNITY, AND FOR THAT WE ARE TRULY GRATEFUL.

UH, TODAY I COME BEFORE YOU WITH IMMENSE GRATITUDE FOR THE IMPROVEMENTS MADE TO LUKE LANE, A LONG OVERDUE UPGRADE THAT HAS UNDOUBTEDLY ENHANCED OUR NEIGHBORHOOD'S QUALITY OF LIFE.

UM, HOWEVER, WHILE EXPRESSED MY APPRECIATION FOR THE NEWLY PAVED STREET, THERE ARE SEVERAL ISSUES THAT I FEEL COMPELLED TO ADDRESS, UH, AS THEY HAVE CAUSED FRUSTRATION AND INCONVENIENCE TO MYSELF AND THE RESIDENTS OF OUR LUKE LANE NEIGHBORHOOD.

FIRSTLY, THERE WAS A SIGNIFICANT LACK OF CLEAR COMMUNICATION THROUGHOUT THIS PROJECT REGARDING WHEN THE PROJECT WOULD BEGIN AND END, AS WELL AS WHERE WE COULD PARK AND ON WHAT DATES AND LEFT RESIDENTS CONFUSED.

AND AT TIMES ARE VEHICLES IN INCONVENIENT OR RESTRICTED LOCATIONS, UH, IMPROVED COMMUNICATION ON PARKING RESTRICTIONS WOULD'VE GREATLY ALLEVIATED THIS ISSUE.

SECONDLY, THERE APPEARED TO BE A LACK OF COMMUNICATION WITH EDCO.

OUR TRASH COLLECTION SERVICE COORDINATION ON DAYS WHEN TRASH SERVICES WOULD BE INTERRUPTED, WAS EVIDENTLY OVERLOOKED, CAUSING DISRUPTIONS TO OUR, UH, TRASH SERVICE.

OUR, THE CLEANLINESS OF OUR NEIGHBORHOOD AS TRASH CANS OVERFLOWED DUE TO MISSED TRASH PICKUPS.

I MYSELF SPOKE WITH AN EDCO DRIVER FOR OUR STREET, WHO WAS QUITE FRUSTRATED TO HAVE TO COME OUT ON A SATURDAY TO PICK UP THE TRASH.

AFTER I MADE A CALL TO THE COMPANY REQUESTING THE PICKUP, HE TOLD ME THE STREET WAS BLOCKED BY THE CONSTRUCTION CREW AND THAT NEIGHBORS SHOULD HAVE MOVED TRASH TO SECOND STREET FOR PICKUP.

HOWEVER, NO ONE COMMUNICATED THIS TO THE RESIDENTS OR TO THE TRASH SERVICE PRIOR TO BALKING ACCESS, UH, TO THE ROAD.

ASIDE FROM THIS EVENT THROUGHOUT CONSTRUCTION, WE WERE NEVER TOLD WHAT DAYS TRASH CANS COULD BE OUT OR NOT ON THE STREET.

FURTHERMORE, AND MORE IMPORTANTLY, THE LACK OF DRAINAGE PLANNING FOR THE FINISHED ROAD SURFACE AND CURBS IS OF REAL CONCERN.

DURING THE LAST MAJOR RAIN EVENT, WE WITNESSED WATER OVERFLOWING IN AREAS THAT NEVER HAD IN THE PAST, UH, FLOWING AROUND CURBS AND ERODING SIGNIFICANT PORTIONS OF DIRT ON THE NORTH SIDE OF THE ROAD.

ALL THIS MUDDY WATER FLOWED ACROSS THE STREET DIRECTLY INTO THE ONLY STORM DRAIN INSTALLED AT THE END OF THE STREET.

IF THIS IS ANY INDICATION OF WHAT TO EXPECT OVER THE COMING YEARS, I FEAR THIS ROAD WILL QUICKLY DETERIORATE DUE TO EROSION.

YOU SHOULD HAVE ACCESS TO PHOTO AND VIDEO DOCUMENTATION OF THIS PROBLEM, WHICH I SENT TO COUNCILMAN PHIL ORTIZ.

UH, ADDITIONALLY, THE CHOICE OF MATERIALS USED FOR THE FINISHING OF

THE ROAD APPEARS QUESTIONABLE WITH EARLY SIGNS OF WEAR AND TEAR DUE TO CARS DRIVING ONTO THE CURB, MOSTLY DELIVERY VEHICLES.

UM, WERE CONCERNED ABOUT THE LONGEVITY OF THE ROAD.

OUR COMMUNITY DESERVES A DURABLE, LONG-LASTING SOLUTION AFTER ENDURING THIS INCONVENIENCE OF THE CONSTRUCTION PROCESS AND DECADES OF, OF OVERSIGHT OF THIS STREET REPAIR.

UM, BEFORE I CONCLUDE, I WOULD BE REMISS NOT TO EXPRESS OUR SINCERE APPRECIATION FOR THE COURTEOUS AND RESPECTFUL CON OF THE CITY INSPECTORS, CONTRACTORS, AND ENGINEERS INVOLVED IN THIS PROJECT.

THEIR COMMITMENT TO ADDRESSING OUR CONCERNS AND ENSURING THE PROJECT'S PROGRESS WAS COMMENDABLE.

IN PARTICULAR, I WOULD LIKE TO HIGHLIGHT THE EXCEPTIONAL PROFESSIONALISM AND DEDICATION OF ASSISTANT ENGINEER CHRISTINE, WHO I BELIEVE IS HERE, UM, WHOSE EFFORTS AND GENUINE ATTENTION TO OUR NEIGHBORHOOD CONCERNS DID NOT GO UNNOTICED.

IN FACT, I BELIEVE IT IS IN LARGE PART DUE TO HER EFFORTS THAT THE CONTRACTORS ARE FINISHING FURTHER REPAIRS AND NECESSARY IMPROVEMENTS TODAY.

UH, THIS COLLABORATION BETWEEN THE COMMUNITY, THE CITY'S REPRESENTATIVES AND THE CONTRACTORS SHOWCASE THE POTENTIAL FOR CONSTRUCTIVE PARTNERSHIPS.

IT IS A TESTAMENT TO THE SPIRIT OF COOPERATION THAT MAKES OUR CITY STRONG.

WE LOOK FORWARD TO CONTINUING THIS POSITIVE RELATIONSHIP AND WORKING TOGETHER TO ADDRESS THE CONCERNS I'VE RAISED WHILE BUILDING A STRONGER, MORE VIBRANT COMMUNITY FOR ALL RESIDENTS.

IN CONCLUSION, WHILE WE ARE VERY GRATEFUL FOR THE EFFORTS PUT INTO UPGRADING LUKE LANE, THESE ISSUES MUST BE ADDRESSED TO ENSURE THAT OUR COMMUNITY ENJOYS THE FULL BENEFITS OF THIS PROJECT.

WE LOOK TO YOU, OUR CITY COUNCIL, TO WORK WITH THE RELEVANT DEPARTMENTS AND AGENCIES TO RECTIFY THESE SHORTCOMINGS AND MAKE SURE LUKE LANE IS A SOURCE OF PRIDE FOR OUR NEIGHBORHOOD.

WHAT'S HIS ROLE? PETER? HE'S A NEIGHBOR AND I THINK HE HAS THE PROPERTY THAT THE WATER WAS OVERFLOWING ONTO AND THE DIRT AND THE GRAVEL.

UM, SO I WENT OUT AFTER THE RAIN.

UH, TODAY ON OUR AGENDA IS TO APPROVE AN ADDITIONAL $50,000 TO CORRECT THAT.

YES, AS I UNDERSTAND, THAT'S TO FINISH THE IMPROVEMENTS THAT THEY'RE CURRENTLY DOING RIGHT NOW.

THAT HAS TO DO WITH CURBS THAT BROKE THE BLACKTOP CURBS AS WELL AS DRIVEWAYS THAT WERE INSTALLED TOO STEEP.

THAT'S NOT TO TO DEAL WITH ANY OF THE ISSUES THAT I ADDRESSED.

UH, I WILL CHECK WITH THE CITY MANAGER ACTUALLY, THE $50,000 INCREASES TO ADDRESS A LOT OF THE ISSUES OUT THERE.

WE THINK THAT SOME OF THOSE ITEMS THAT THE RESIDENT POINTED OUT WILL HELP RESOLVE SOME OF THOSE ISSUES.

IT'S ALSO, IT'S IMPORTANT FOR THE COUNCIL TO RECOGNIZE THAT THIS NEIGHBORHOOD WAS DEVELOPED IN A WAY THAT WE WOULD NEVER DEVELOP IT TODAY, RIGHT.

WITH, WITH THE, WITH THE DIFFERENT GRADE OF STREET AND HOUSES.

AND SO WE'RE HAVING TO SORT OF BACKWARD ENGINEER SOME OF THE STREET.

AND SO THERE WE ARE ASKING THE RESIDENTS TO BE A LITTLE BIT PATIENT WITH US AS WE TRY TO FIGURE OUT THE BEST WAY.

AND, AND WE RECOGNIZE THAT THIS WILL BE A BIT OF AN ONGOING PROCESS AND WE MAY HAVE TO WAIT UNTIL THE RAIN NEXT RAINSTORM, UNLESS WE BRING OUT HELICOPTERS FULL OF WATER TO SIMULATE RAINSTORMS, WHICH WE'RE NOT GONNA DO THAT.

UM, BUT WE MAY HAVE TO SEE WHAT THE NEXT RAINSTORM BRINGS UNTIL WE DO SMALL CORRECTIONS OVER TIME.

ITEM 11 IS AN UPDATE ON THE MAGNOLIA'S FINANCIAL PERFORMANCE, AND I'LL ASK STAFF TO TELL US ALL ABOUT THIS.

GOOD AFTERNOON, MAYOR AND COUNCIL MEMBERS.

I'M JOINED, UH, TODAY BY PARIS LANDON THE MAGNOLIA'S, UH, GENERAL MANAGER.

UM, WE'RE HERE TO PROVIDE A FINANCIAL UPDATE ON THE MAGNOLIA SINCE IT OPENED IN SEPTEMBER OF 2019.

UH, PARIS IS ALSO HERE TO SHARE SOME OF THE EXCITING SHOWS COMING UP AND DEVELOPMENTS AT THE MAGNOLIA, AS WELL AS SOME INSIGHTS ABOUT OUR CUSTOMERS.

BEFORE I DIVE INTO WHERE WE ARE TODAY, UM, I WANTED TO TOUCH ON WHERE WE WERE AT BACK IN 2009, UH, PRIOR TO CLOSING THE BACK, OR WHAT USED TO BE THE EAST COUNTY PERFORMING ARTS CENTER.

UM, BACK IN 2005, THE CITY SIGNED A MANAGEMENT AGREEMENT WITH ART BEAT, UH, WHICH WAS A SUBSIDIARY OF THE CHRISTIAN YOUTH THEATER, UH, TO MANAGE THE FACILITY.

BY 2009, UM, ART BEAT HAD DEFAULTED ON THE MANAGEMENT AGREEMENT, UM, BECAUSE THEY FAILED TO PROVIDE HEADLINE ACTS, UM, CITING THE DIFFICULTY OF COMPETING WITH LOCAL CASINOS.

AT THE TIME, THE CITY WAS SPENDING ABOUT $600,000 A YEAR TO KEEP THE DOORS OPEN.

AND THAT COUPLED WITH A RECESSION LED TO THE CLOSURE OF, UH, THE PAC.

UH, THE CITY RECOGNIZED THAT IF WE WERE GONNA REOPEN THE THEATER WITH A DIFFERENT RESULT, THAT WE WOULD NEED A DIFFERENT MANAGEMENT MODEL FOR THE THEATER.

IN 2017, THE CITY BEGAN NEGOTIATING WITH LIVE NATION, THE, UH, WORLDWIDE LEADER IN LIVE ENTERTAINMENT.

UM, AND BY 2019, WE HAD SIGNED AN AGREEMENT WITH LIVE NATION, UH, TO HELP US RENOVATE AND MANAGE, UH, THE MAGNOLIA.

SHORTLY AFTER EXTENSIVE RENOVATIONS BEGAN AND THE THEATER WAS REBRANDED TO THE MAGNOLIA.

SO THE MAGNOLIA HOSTED ITS FIRST OPENING EVENT IN SEPTEMBER OF 2019.

UH, BUT BY MARCH, 2020, JUST SIX MONTHS AFTER OPENING, UH, COVID STRUCK, AS YOU ALL RECALL, AND THE STATE AND COUNTY REGULATIONS FORCED THE FACILITY TO CLOSE IN SEPTEMBER OF 2021.

AFTER 19 MONTHS, THE FACILITY WAS ALLOWED TO REOPEN, ALBEIT KIND OF SLOWLY, UH, BECAUSE OF, UM, CAPACITY, UH, RESTRICTIONS AND COVID SURGES RE KIND OF REAPPEARING TO ACCOUNT FOR THIS.

IN, UM, MARCH OF THIS YEAR, THE CITY COUNCIL APPROVED A TWO YEAR CONTRACT EXTENSION WITH LIVE NATION, WHICH EXTENDS THE CONTRACT TO AUGUST OF 2026.

OKAY, SO AS WE TAKE A LOOK OR GET INTO THE FINANCIAL PERFORMANCE OF THE, THE MAGNOLIA, THERE'S REALLY TWO PERFORMANCE METRICS, UM, ESTABLISHED IN THE MANAGEMENT AGREEMENT.

ONE WAS EVENTS PER CONTRACT YEAR, UH, WHICH IS WHAT THIS GRAPH SHOWS.

AS YOU CAN SEE, THE TEAL LINES, UM, SHOW THE CONTRACTED NUMBER OF EVENTS PER YEAR.

SO THAT'S WHAT'S SPECIFIED IN OUR MANAGEMENT AGREEMENT AS A, UH, PERFORMANCE METRIC.

AND THEN THE DARK BLUE LINE SHOWS THE ACTUAL NUMBER OF EVENTS, UM, PUT ON IN THAT FISCAL YEAR OR THAT CONTRACT YEAR.

UM, THE FIRST TWO YEARS, YOU SEE THE IMPACTS OF COVID.

UM, WE OPENED THE FACILITY FOR ABOUT SIX MONTHS, GOT 42 EVENTS OUT, UM, AND THEN SHUT DOWN.

AND THEN THE SECOND YEAR WE, WE LITERALLY, I THINK IT WAS A COUPLE PRIVATE RENTALS.

AND THEN, UM, BY THE THIRD YEAR, UH, WE REOPENED IN SEPTEMBER.

SO A COUPLE MONTHS INTO THAT, DESPITE THE SLOW AND GRADUAL REOPENING, WE'RE STILL STILL ABLE TO GET OUT 60 EVENTS IN THAT YEAR.

UM, AND THEN YOU LOOK AT LAST YEAR, WHICH IS JULY OF 22 THROUGH 23, UH, JUNE OF 23, AND WE HOSTED 80 EVENTS, WHICH IS 20 MORE THAN

THE CONTRACT, UM, TARGET AND 20 MORE THAN LAST YEAR.

SO YOU CAN SEE WE'RE REALLY RAMPING UP OPERATIONS AT THE FACILITY.

AND THEN SO FAR THIS YEAR, AND THAT'S THAT FINAL YEAR ON THE RIGHT, WE'VE UH, BOOKED 51 EVENTS THROUGH DECEMBER.

SO THAT'S HALF THE YEAR WE'RE AT 51 EVENTS.

UM, SO IT LOOKS LIKE WE'RE GONNA MEET OUR TARGET THIS YEAR AS WELL.

THE SECOND, UH, PERFORMANCE METRIC, UM, SPECIFIED IN THE AGREEMENT WAS IN THE FORM OF A PRO FORMA OR A FINANCIAL FORECAST.

UM, SO THAT'S WHAT THIS GRAPH SHOWS.

UM, THE MAGNOLIA'S A O I IS WHAT'S, UH, DEPICTED HERE, WHICH IS BASICALLY THE ADJUSTED OPERATING INCOME.

IT'S WHAT WE GET WHEN WE DEDUCT THE, UH, SHOW EXPENSES FIXED AND, UH, VARIABLE EXPENSES FROM THE, FROM THE VENUE'S REVENUE.

SO WHEN WE SIGNED THIS AGREEMENT, WE ANTICIPATED, UM, THAT WE WOULD BE SUBSIDIZING THE FACILITY, UM, FOR THE FIRST FIVE YEARS.

AND YOU CAN SEE THE TEAL LINE THERE, UH, ABOUT $325,000 ANNUALLY.

AND THEN THE DARK BLUE LINE DEPICTS THE ACTUAL, UM, A O I FOR THE FACILITY.

SO AGAIN, YOU CAN SEE THE FIRST TWO YEARS THE FACILITY DIDN'T PERFORM THAT WELL BEING CLOSED.

UM, BUT BY YEAR THREE AND FOUR, YOU CAN SEE WE'RE OPERATING AT ABOUT $300,000 A YEAR IN THE, UM, IN THE GREEN OR DARK BLUE IN THIS INSTANCE, WHICH IS A DIFFERENCE OF ABOUT $600,000 FROM THE BOTTOM OF THE TEAL BLUE LINE TO THE TOP OF THE, TO DARK BLUE LINE.

SO IT'S OUTPERFORMING ITS EXPECTATIONS BY ABOUT $600,000 ANNUALLY.

SO APART FROM THE MAGNOLIA'S, A O I, THE CITY HAS ADDITIONAL EXPENSES.

UM, THE CITY PAYS LIVE NATION AN ANNUAL CONTRACT COST OF $375,000 A YEAR TO MANAGE THE FACILITY.

IN ADDITION, WE HAVE ABOUT $250,000 ANNUALLY IN, UH, UTILITY AND MAINTENANCE COSTS.

WE BEGAN TRANSITIONING THE UTILITY COSTS ABOUT SIX MONTHS AGO OVER TO LIVE NATION, UM, SEEING AS A, AS BETTER FIT AS A OPERATING EXPENSE.

AND THIS YEAR THAT BROUGHT OUR EXPENSES DOWN TO 1 22.

UM, NEXT YEAR WE ANTICIPATE IT'LL BE DOWN EVEN FURTHER AS WE'LL HAVE A FULL YEAR UNDER OUR BELT.

WITH LIVE NATION PAYING THE UTILITY BILLS, THIS TRANSFER IS IMPORTANT AS A FACILITY NEAR PROFITABILITY.

AND, UM, SOME OF OUR PROFIT SHARING THRESHOLDS, IT ALSO DECREASES, IF YOU LOOKED AT THE A O I FROM THIS SLIDE, IT DECREASED, UM, WHAT WOULD'VE BEEN AN A O I OF ABOUT $400,000 FOR THE FACILITY.

THIS NEXT SLIDE IS OUR NET POSITION.

SO ESSENTIALLY THAT'S ADDING THE A O I OF THE MAGNOLIA AND THE CITY'S EXPENSES TOGETHER, AND IT GIVES US THIS NET POSITION.

SPANISH MUSIC WAS SOLD OUT CAFE TO CUBA BEACH HOUSE, WHICH SOLD OUT TO A YOUNG HIPSTER DEMOGRAPHIC.

UM, AND THEN ALSO WE HAVE FAMOUS COMEDIANS, NICK SWARDSON AND SETH MEYERS.

AND EVEN A GREAT AMOUNT OF CHILDREN'S EVENTS, INCLUDING DISNEY, JUNIOR LIVE, AND PEPPA PIG.

THE ARTISTS WE BRING IN DON'T JUST COME FROM THE LOCAL AREA.

OUR SPECIAL EVENTS DEPARTMENT CONTINUES TO GROW.

LAST YEAR WE HAD A LOT OF REPEAT CLIENTS, TEDX KIDS, CAMP CAJON, THE EAST COUNTY TRANSITIONAL LIVING CENTER, UH, WITH HEADLINER MAYOR WELLS, AND ALSO MANY NEW EVENTS INCLUDING HEROES OF COLOR, WHICH CELEBRATED FIFTH GRADE ART FROM THE NATIONAL CITY STUDENTS GUIDING HANDS CONCERT, BENEFITING THOSE WITH SPECIAL NEEDS, AND EVEN AN EAST INDIAN SPIRITUAL CELEBRATION FOR ONE OF THEIR LEADERS.

WE'RE EXCITED TO SEE THE NUMBER OF SPECIAL EVENTS GROWING AND CONTINUE TO WORK ON, UH, THAT BUSINESS REVENUE STREAM.

WE WANTED TO TOUCH BASE ON THE USE OF WASTE MANAGEMENT SPONSORSHIP MONEY AND HOW IT'S BEEN USED TO BRING IN A-LIST ARTISTS AND DO COMMUNITY EVENTS LIKE THE HAUNTED CIRCUS.

WE BUILT OUT TWO NEW BACK BARS WITH FRIDGES, UH, TO HELP INCREASE THE SPEED OF SERVICE AND ALSO GIVE A BETTER DISPLAY FOR OUR GUESTS AND IMPROVE THEIR EXPERIENCE.

LOOKING AHEAD, WE HAVE A VERY BUSY FALL COMING WITH 51 EVENTS CURRENTLY ON THE BOOKS FROM JULY THROUGH THE END OF THE YEAR.

AND A LOT OF TIMES THERE'S NOT PLACES OPEN.

BUT I THINK USING, YOU KNOW, MAYBE THE MAGNOLIA'S WEBSITE, IT'S A CITY ASSET TO HAVE A TAB OF, HEY, VISIT THESE GREAT RESTAURANTS WHEN YOU'RE PLANNING YOUR VISIT, WHEN YOU'RE COMING.

AS WE CONTINUE TO GROW AND AS DAVE SAID, BUILD THESE PARTNERSHIPS AND MAYBE SOME PEOPLE DO WANNA HAVE A LOT OF COORDINATION, THAT'S SOMETHING WE CAN DEFINITELY LOOK AT AND IT'S ONE OF OUR GOALS TO BRING MORE PEOPLE INTO THE COMMUNITY, NOT JUST SPENDING MONEY IN THE BUSINESS, BUT IN THE COMMUNITY AS WELL.

UH, MY FINAL QUESTION IS ABOUT THE FOOD AT, AT THE PRE-SHOW.

IS THAT PART OF YOUR NATIONAL FOOD SERVICE CONTRACT OR THOSE LOCAL VENDORS AS WELL? UH, THAT IS A INTERNAL EMPLOYEE, SO THROUGH OUR FOOD AND BEVERAGE CONTRACT.

SO HE'S MAKING THE FOOD ON SITE AS AN EMPLOYEE AND SERVING THE FOOD.

UM, AND I DUNNO IF THAT ANSWERS IT ACCURATELY.

, SO YOU HAVEN'T, YOU, YOU HAVEN'T FOUND A, A LOCAL BUSINESS THAT HAS SAID, HEY, WE'D LOVE TO DO THAT.

THERE'S NO ADDITIONAL COST TO PAY ANOTHER THIRD VENDOR.

AND ARE YOU FINDING, UH, INTEREST FROM DESSERT, PASTRY CAKE COOKIE VENDORS TO HAVE THOSE KIND OF DRY GOODS ON SITE? UH, WE HAVEN'T HAD A LOT OF INTEREST.

UM, DEFINITELY OUR FOOD AND BEVERAGE MANAGER WENT AND SPOKE TO A FEW LOCAL PEOPLE IN THE COMMUNITY, UM, LOOKING AT DIFFERENT FOOD OPTIONS, BUT THE PRICE POINTS WAS JUST NOT GONNA WORK FOR WHAT WE NEED TO BE ABLE TO MAKE A PROFIT ON IT.

UM, AND IT WAS DIFFICULT BECAUSE THEY WERE HAVING TROUBLE MAKING THE APPROPRIATE AMOUNT WITHOUT CHARGING US EXTRA.

SO I THINK IT'S SOMETHING WE'RE GONNA CONTINUE TO WORK ON, BUT HAVING A LOCAL PARTNERSHIP WITH, UM, AN EL CAJON BUSINESS THAT SERVES BEER IS GREAT BECAUSE I CAN KEEP IT IN THE FRIDGE AND IT'S GONNA BE GOOD FOR THE NEXT SHOW.

UH, AN OPERATING COVENANT IS REALLY A TECHNICAL WAY TO SAY A, A SALES TAX SHARING AGREEMENT.

AS YOU, AS A COUNCIL IS AWARE, THE CITY HAS SIMILAR AGREEMENTS WITH, UH, HONDA B M W, MERCEDES-BENZ, AND MOST RECENTLY MAZDA DEALERSHIPS.

AND THESE HAVE BEEN IN PLACE OVER THE LAST COUPLE YEARS.

THE INTENT OF THIS AGREEMENT IS REALLY TO HELP CARMAX, UH, BRIDGE SOME UNFORESEEN COSTS AS PART OF THEIR DEVELOPMENT OF THE SITE.

THEY CURRENTLY, THE, THE, THE NEAREST LOCATION OF A CARMAX TO EL CAJON RIGHT NOW IS IN KEARNEY MESA.

SO THE SITING OF A CARMAX IN EL CAJON WILL HELP DRAW FROM A LARGE SWATH OF POTENTIAL CUSTOMERS THROUGHOUT THE COUNTY OF SAN DIEGO.

WE ESTIMATE, BASED ON THEIR PROFORMA THAT OVER THE NEXT DECADE IT'LL GENERATE ABOUT $7 MILLION IN GENERAL FUND REVENUE TO THE CITY OF EL CAJON THROUGH THIS CAR DEALERSHIP.

SO CARMAX PLANS TO OPEN AT 1100 WAGNER DRIVE.

AS YOU CAN SEE FROM THE MAP, UM, IT ABUTS TO A NEIGHBORHOOD TO THE WEST OF IT, UM, BUT IT ALSO IS ACROSS THE STREET FROM WAGNER, FROM THE MERCEDES DEALERSHIP, AND ACROSS, UH, MARSHALL FROM THE TOYOTA, HONDA, AND LEXUS DEALERSHIP.

SO IT'S IN A AREA THAT, UM, IS, IS USED TO HAVING AUTO DEALERSHIPS.

THIS SITE HAS BEEN VACANT FOR ABOUT SIX YEARS.

IT WAS CURRENTLY, OR WAS PREVIOUSLY OPERATED BY CASE CONSTRUCTION WHO VACATED THE SITE, LIKE I SAID, ABOUT SIX, UH, SIX MONTHS AGO, SO, OR SIX YEARS AGO.

SO THIS LOT AT THIS POINT HAS GENERATED NO REAL ECONOMIC IMPACT TO THE CITY OF EL CAJON.

IT SAT VACANT CREATING A BLIGHTING CONDITION IN THE NEIGHBORHOOD, AND IT ALSO, UM, HA HAS, HAS, HAS HAD SOME MISSED OPPORTUNITIES.

THIS HAS BEEN A SITE THAT'S BEEN ACTIVELY PROMOTED.

UH, CITY STAFF HAS REVIEWED SEVERAL APPLICATIONS OVER THE LAST COUPLE YEARS.

UH, A LOT OF THEM HAVING TO DO WITH CONSTRUCTION YARDS, UH, OF THAT NATURE.

AND WE HAVE STAFF HAS PUSHED BACK ON THOSE BECAUSE WE THOUGHT HOLDING OUT FOR A DEALERSHIP MADE A LOT MORE SENSE IN THIS AREA.

SO WHAT THIS AGREEMENT WOULD DO IS OBLIGATE CARMAX TO COMPLETE THE DEVELOPMENT, UH, ABOUT A $12 MILLION DEVELOPMENT AND OPEN UP ITS DOORS BY THE END OF MARCH, 2027.

AND THEN THEY'D BE REQUIRED TO STAY OPEN DURING THE DURATION OF THE AGREEMENT, WHICH IS AN EIGHT YEAR AGREEMENT.

THE CITY'S OBLIGATION IS THAT IT WOULD SHARE SALES TAX AFTER IT RECEIVED $350,000 OF A THRESHOLD OR A BASE SALES TAX.

SO ONCE THAT, THAT $350,000 IS GENERATED, THEN THE CITY WOULD SHARE, UM, A PORTION OF THE REMAINING SALES TAX TO CARMAX, UH, STAFF HAS DEVELOPED A, A SCALE BY WHICH THE SALES TAX WOULD BE RATCHETED FROM 75% GOING TO THEM DOWN TO 50% IN YEAR EIGHT.

THIS IS A VERY SIMILAR ARRANGEMENT TO A LOT OF THE CURRENT AGREEMENTS THAT WE HAVE.

ALTHOUGH MOST OF OUR AGREEMENTS WOULD HAVE, THE FIRST FIVE YEARS WOULD BE 75%, OR IN ONE CASE 65%.

UM, THIS YEAR, UNDER THIS MODEL, IT ACTUALLY RATCHETS IT DOWN EVERY SINGLE YEAR.

ONE OF THE INTENTS OF THIS IS, AS CARMAX IS GETTING UP AND RUNNING, UH, WE WOULD SHARE A GREATER PORTION OF THAT MONEY, BUT AS THEY, THEIR SALES GROW, THEN THE CITY BEGINS TO GET A BIGGER PORTION OF THAT GROWTH IN SALES.

THE OTHER THING THAT MAKES THIS AGREEMENT DIFFERENT THAN THE OTHER SALES TAX SHARING AGREEMENTS THAT WE HAVE IS WE ACTUALLY HAVE THE AGREEMENT CAPPED AT A CERTAIN DOLLAR AMOUNT.

SO ONCE THE $2 MILLION MARK IS REACHED, AND LET'S SAY THAT IT'S ACCOMPLISHED IN YEAR FIVE, THE AGREEMENT WITH TERMINATING IN YEAR FIVE, IT WOULD NO LONGER CONTINUE TO GO ON.

AND SO THE CITY IS THEN PROTECTED

OR, AND ITS TAXPAYERS ARE PROTECTED FROM ONGOING SHARE OF REVENUE.

SO WITH THAT, UM, STAFF IS HERE TO ANSWER ANY QUESTIONS THAT YOU HAVE.

AND THERE'S VARIOUS TERMS DEPENDING ON THE, UM, THE SUBSIDY AND THE AMOUNT OF, UM, AFFORDABILITY FOR EACH OF THE UNITS.

UM, THE A D U MUST REMAIN AFFORDABLE DURING THE TERM OF THE LOAN FOR A MINIMUM OF FIVE YEARS.

AND THE TENANT'S INCOME CANNOT EXCEED 150% OF THE AREA MILLION INCOME.

AND I THINK ONE OF, UH, ONE OF THE THINGS I HEAR IS THAT, UH, THE HOMELESS PEOPLE ARE RELUCTANT TO GIVE UP THEIR PETS.

AND A LOT OF TIMES THE PETS ARE THE ONLY ONES THAT ARE LEFT THAT LOVE THEM UNCONDITIONALLY.

AND I'M TRYING TO ELIMINATE ALL THE BARRIERS TO THE HOMELESS PEOPLE GETTING INTO THE PROGRAM.

AND I THINK IF WE COULD FIGURE OUT A WAY TO TAKE, TAKE CARE OF THEIR PETS WHILE THEY'RE IN A PROGRAM, THEY WOULD BE LESS RELUCTANT, UH, TO TURN DOWN THE PROGRAM.

SO, UH, I WOULD LIKE TO ASK THE STAFF TO COME UP WITH SOME IDEAS AND FUNDING SUGGESTIONS AS TO HOW WE CAN ACCOMPLISH THAT.

AND I, I THINK THAT THIS IS A SITUATION WHERE WE CAN ACTUALLY SAVE LIVES.

YOU KNOW, A CONTRACT WOULD HAVE TO BE MADE, AND I KNOW THAT THERE'S GONNA BE SOME COST INVOLVED.

UM, BUT IF WE COULD EXPLORE THIS, AND THAT'S JUST ONE BARRIER THAT WE CAN, UM, TAKE DOWN SO THAT WHEN WE ARE OFFERING, WHEN KARINA AND HER TEAM ARE OUT THERE AND THEY'RE OFFERING SERVICES TO THE HOMELESS, UH, WELL, I DON'T WANNA GO IN BECAUSE I'VE GOT DOGS.

IF IT WAS AVAILABLE, YEAH.

SO THE FIRST QUESTION, I THINK THERE IS A LOT OF INDIVIDUALS WHO ARE EXPERIENCING HOMELESSNESS THAT DO HAVE PETS.

AND ARE WE RELUCTANT TO SERVICES? IT IS ALSO PART OF A BARRIER WHEN WE TRY TO PERMANENTLY HOUSE THEM, BECAUSE A LOT OF THE TIMES THEY NEED TO BE A SERVICE ANIMAL AND IT IS HARD TO GET THEM TO A CLINIC DOWNTOWN, WHICH IS PART OF GETTING THE ANIMAL A SERVICE TO BE A SERVICE ANIMAL.

UM, IF WE WERE TO PUT 'EM IN SHELTER AND THEY'RE ABLE TO HAVE TIME TO GET THAT DONE AND WE PROVIDE TRANSPORTATION, I THINK THEY'LL BE MORE OPEN TO SERVICES.

THE SECOND PART, I DON'T KNOW HOW MUCH, LIKE, I THINK IT'D BE 50, 50% OF SOMEONE SAYING, YES, PUT MY, UH, PET IN THE SHELTER AND I CAN VISIT.

UM, WHY RECEIVE SERVICES? WE'LL HAVE SOME THAT WILL SAY NO.

UM, FOR US, WHEN WE DO PUT THEM IN EMERGENCY SHELTER, WE DO COVER THE PET COSTS, UM, IN THE MOTEL.

I KNOW FOR E C T L C, THEY DON'T ALLOW THE PETS TO COME IN.

SO IT WOULD JUST BE A MATTER OF GETTING A COPY OF THEIR AGREEMENT, LOOKING AT WHAT THEIR COSTS WOULD BE.

I BELIEVE WHEN YOU SUBMIT A DOG TO THE HUMANE SOCIETY, THEY'LL DO SHOTS.

AND SO WE WOULD BE PAYING FOR ALL OF THOSE SERVICES AS WELL.

UM, THE MORE COMPLICATED WOULD BE TO REACH OUT TO DIFFERENT ORGANIZATIONS.

I KNOW, UH, PER, ON A PERSONAL LEVEL, MY, MY WIFE WATCHES DOGS PROFESSIONALLY, THAT'S ONE, ONE OF HER JOBS.

AND I KNOW FROM WHAT I HEARD JUST TODAY THAT ONE OF THE THINGS THAT, THAT WOULD PROBABLY A PREREQUISITE OF A PROGRAM IS THE ABILITY TO GO VISIT YOUR ANIMAL WHILE YOU'RE RECEIVING SERVICES.

SO I DON'T KNOW HOW MANY FOSTER PARENTS WOULD BE COOL WITH PEOPLE SHOWING UP AT THEIR HOME AND SPENDING TIME WITH THEIR DOG AT THEIR HOUSE.

SO THOSE ARE THE THINGS THAT HAVE TO BE FLUSHED OUT.

I THINK THAT'S A, A MORE COMPLEX, SO STAFF COULD COME BACK THAT'S REALLY QUICKLY IN THE NEXT MEETING OR TWO WITH HERE'S WHAT THE HUMANE SOCIETY OFFERS, WHERE DO YOU WANT US TO GO? AND THAT COULD BE, WE DON'T LIKE IT, GO EXPLORE MORE.
