UM, THE PROPOSAL IS FOR A 10 FOOT TALL PROPANE TANK.

UM, IT'S SUBMITTED BY COMPARING ASSOCIATES ON BEHALF OF QUICK TRIP, INC.

UM, SO THE PROPOSAL INCLUDES, UH, THE 10 FOOT TALL PROPANE TANK, A CMU, UH, ENCLOSURE, UH, AND BOLLARDS AND THE REMOVAL OF TWO PARKING SPACES FROM AN EXISTING AUTOMOTIVE FUELING STATION, UH, ADDRESS THAT 5 96 NORTH MAULSON AVENUE.

THE, UH, PROJECT WAS WITHIN THE GENERAL COMMERCIAL GENERAL PLAN DESIGNATION AND HAS A CONSISTENT ZONING DESIGNATION OF CG GENERAL COMMERCIAL.

THE EXISTING AUTOMOTIVE FUELING STATION IS PERMITTED VIA CONDITIONAL USE PERMIT NUMBER 1805 A WHICH HAS BEEN AMENDED A NUMBER OF TIMES THROUGH THE YEARS.

UM, SPECIFIC PLANS NUMBERS 1 0 6 AND 2, 2 7 ALSO ARE APPLICABLE TO THE SITE.

UH, THEY ALLOW FOR INTERCONNECTING ACCESS AND SHARED PARKING BETWEEN THREE COMMERCIAL PROPERTIES, THE THREE PROPERTIES BEING THE, UM, THE AUTOMOTIVE FUELING STATION, THE MOTEL TO THE WEST.

SO TO THE REAR OF THE FUELING STATION AND AN ADJACENT THROUGH RESTAURANT.

UM, THE REASON THAT THIS MINOR AMENDMENT IS, UH, BEFORE YOU TONIGHT IS BECAUSE, UH, OUR, OUR POLICIES, UH, OR PLANNING PERMIT POLICIES FOR MINOR AMENDMENTS, UH, STATE THAT IF THERE'S A SPECIFIC ITEM OF CONCERN IN THE PROJECT RECORD, THAT THAT SHOULD COME BEFORE THE PLANNING COMMISSION FOR CONSIDERATION.

UM, IN THIS CASE, UH, THE PROJECT RECORD INCLUDES A LOT OF, UH, DELIBERATION REGARDING, UH, FUELING TRUCK EGRESS AND INGRESS INTO THE SITE.

UM, AND SO OBVIOUSLY ADDING A, ANOTHER, YOU KNOW, A DIFFERENT TYPE OF FUEL, BUT STILL FUEL, UH, TO THE SITE, UH, IS THE REASON WE BROUGHT IT TO YOU TODAY.

UM, SO HERE'S AN AERIAL IMAGE OF THE SITE.

UM, IT'S LOCATED JUST SOUTH OF THE , UH, EXIT, UM, OFF-RAMP AT NORTH MOLLISON.

UM, I'VE HIGHLIGHTED HERE THE KIND OF THE STRANGE PROPERTY LINES THAT EXIST THERE AS YOU CAN SEE, THE, THE MOTEL TO THE WEST, UM, DOES NOT HAVE FRONTAGE ON A PUBLIC STREET.

AND SO THAT'S THE REASON FOR THAT SPECIFIC PLAN FOR INTERCONNECTING ACCESS.

UM, THE PROPOSED TANK, AS I'LL DISCUSS A LITTLE BIT LATER IS TO THE WEST OR TO THE REAR OF THAT EXISTING CONVENIENCE MARKET AT THE FUELING STATION, UM, WHICH WOULD NOT BE VISIBLE FROM NORTH BOSTON, BUT IS VISIBLE, UM, FROM THE FREEWAY EXIT OFF RAMP.

AND THIS IS PROBABLY ISN'T THE BEST MEDIUM TO TAKE IN THE SITE PLAN HERE.

UH, BUT AGAIN, TO THE WEST OF THAT EXISTING CONVENIENCE MARKET, YOU'LL SEE IN THE BUBBLE DIVERSION HERE, UH, WHERE THE PROPOSED TANK WOULD GO, IT'S NEXT TO SOME OTHER EXISTING EQUIPMENT, UH, LIKE A VACUUM STATION, A TRANSFORMER BOX AND THE TRASH ENCLOSURE.

SO I WON'T REITERATE AGAIN, BUT IT'S LOCATED TO THE REAR OF THE COMEDIANS MARKET.

IT'S NOT VISIBLE FROM THE STREET AND THE PUBLIC STREET.

UM, IT, THE PROPOSAL INCLUDES A, UH, LIKE A THREE WALL DESIGN CMU ENCLOSURE WITH BOLLARDS, WHICH WOULD BE SIMILAR TO THE EXISTING PROPANE TANK.

THAT'S AT THE FRONT OF THE PROPERTY.

UM, AGAIN, IT'S NEAR OTHER ACCESSORY EQUIPMENT.

THE SITE STILL MEETS ITS PARKING REQUIREMENTS, EVEN IF THE REMOVAL OF THOSE TWO PARKING SPACES FOR THE NEW TANK.

UM, AND THE, UH, THE SPECIFIC PLAN ALSO INCLUDES KIND OF AN, UH, AN ALREADY APPROVED EXHIBIT FOR CIRCULATION, FOR FUELING VEHICLES.

UM, THIS PROPOSAL WOULD NOT MODIFY, UH, TO ANY GREAT DEGREE THAT, UM, APPROVED FUELING VEHICLE CIRCULATION PATH, ESSENTIALLY, UM, THAT IS IN PLACE TO ENSURE THAT FUELING VEHICLES DON'T DRIVE ALL THE WAY AROUND THE MOTEL TO EXIT BACK ONTO NORTH MOLLISON.

THEY HAVE AN IMPROVED ROUTE TO COME IN BACK OUT AND TURN AROUND, UH, AND HERE'S A PHOTOCOPY OF A PHOTOCOPY OF A SCAN OF THAT DETAIL FROM AN OLD SPECIFIC PLAN.

UH, AND SO SOME OF THE CONDITIONS OF APPROVAL, UH, WOULD BE TO KIND OF UPDATE, UH, THE DIRECTIONAL SIGNAGE, THE NO PARKING SIGNAGE ON SOME OF THOSE DRIVE AISLES WHERE THE FUELING TRUCKS NEED TO TRAVERSE, UH, AND SOME SPECIFIC SIGNAGE FOR THE FUELING TRUCKS, SO THAT THEY KNOW, UH, THE APPROVED WAY TO INGRESS AND EGRESS FROM THE SITE.

UM, UH, CONDITIONS ALSO INCLUDE SOME CONDITIONS THAT WERE ON AN OLDER APPROVAL THAT WEREN'T NECESSARILY IMPLEMENTED, UH, FOR, YOU KNOW, DIRECTIONAL ARROWS ON THE GROUND AND THAT SORT OF, UH, SIGNAGE, UM, AND ALSO REQUIRES COMPLIANCE FOR, WITH OUR WINDOW REGULATIONS ON THE GROUND FLOOR.

UH, AND THEN A GENERAL REQUIREMENT TO UPKEEP LANDSCAPE, WHICH IS KIND OF INCLUDED WITH ALL OF OUR RECENT APPROVALS.

UH, THIS PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, UH, PURSUANT TO SECTION 15, 3 0 3 FOR NEW STRUCTURES, UH, INCLUDING, YOU KNOW, SMALL ACCESSORY EQUIPMENT.

UM, STAFF RECOMMENDATION IS APPROVAL OF MINOR AMENDMENT 2021 DASH 0 0 0 5 SUBJECT TO CONDITIONS.

UM, SINCE THE CONFORMS WITH THE CG ZONE STANDARDS FOR AUTOMOTIVE FUELING, THIS WOULD PROMOTE A LOCAL BUSINESS TO MEET CUSTOMER DEMANDS AND KEEP HIS RATES LOW FOR THAT TYPE OF FUEL.

UH, AND THE PROPOSED CONDITIONS ADDRESS, YOU KNOW, THE ONGOING CONCERN OF FUELING VEHICLE INGRESS, EGRESS, AND SIGNAGE.

AND THAT CONCLUDES STAFF'S PRESENTATION.

AND THEY FELT THAT, UH, THERE MAY BE A RESTRICTION ON THE TYPE OF USES THAT'S PREVENTING DEVELOPMENT AND ON THOSE PROPERTIES.

SO THEY HAVE ASKED THAT THOSE PROPERTIES THAT ARE NORTH OF MADISON ON MAGNOLIA, THAT WITHIN THE DOWNTOWN MASTER PLAN BE ALLOWED TO REDEVELOP WITH USES THAT ARE NORMALLY FOUND ADJACENT TO A FREEWAY.

SO FREEWAY ORIENTED USES SUCH AS LODGING CHARGING AND FUELING STATIONS, CONVENIENCE MARKETS, RESTAURANTS, AND THE OPPORTUNITY FOR A, UM, A DRIVE-THROUGH COMPONENT WITH A BUSINESS.

WOULD THAT CHANGE THE ENTIRE PICTURE, OR WOULD THAT BE AN ACCEPTABLE STEPH THINKS THERE'S AN OPPORTUNITY FOR TABLES AND CHAIRS.

SO IF SOMEBODY WANTED TO HAVE A BIT OF A RESPITE IN FRONT OF THE FOOD TRUCK OR TRAILER, WE THINK THAT THERE'S AN OPPORTUNITY FOR THAT ON SELECT SITES.

UM, FOR NEW RESIDENTIAL PROJECTS, WE'RE PROPOSING STAFF IS PROPOSING A, UM, UM, REMOVING VOCATIONAL TRADE SCHOOLS AND IDENTIFYING THOSE AS OTHER USES, NOT LISTED IN THE COMMERCIAL AND INDUSTRIAL, UM, PARKING TABLE.

UM, STAFF BELIEVES THAT THIS IS MORE APPROPRIATE FOR THEM TO BE IN OTHER USES, NOT LISTED CATEGORY WHERE DEPENDING ON THE SCHOOL REALLY D TYPE SCHOOL TYPE REALLY DETERMINES THEIR PARKING DEMAND.

AND THERE'S ALREADY A SECTION IN THE LAND USE OR THE PARKING TABLE THAT ALLOWS THE DIRECTOR TO DETERMINE THE PARKING NEED.

AND SO WE'RE ASKING THE PLANNING COMMISSION TO MOVE VOCATIONAL AND TRADE SCHOOLS INTO THIS OTHER USES NOT LISTED CATEGORY.

OH, WE'RE ALSO, UM, UM, NEEDING TO FIX SOME GRAMMAR IN THE PARKING TABLE AS WELL.

HOUSEHOLD PETS ARE, UH, CLEARLY IDENTIFIED IN THE ZONING CODE TO ONLY BE ALLOWED IN CORE RESIDENTIAL ZONES.

WE THINK THIS IS A PROBLEM BECAUSE WE DO HAVE, OR RESIDENTIAL UNITS AND OTHER ZONES.

SO THINK ABOUT A CARETAKER UNIT THAT MIGHT BE IN A COMMERCIAL ZONE OR EVEN IN AN INDUSTRIAL ZONE.

AND SO WE JUST WANT TO MAKE IT CLEAR THAT ANY HOUSEHOLD OR ANY RESIDENTS CAN HAVE THEIR PETS.

UM, YOU'VE BEEN CHICKENS, NO CHICKEN, NO, SIR.

THOSE ARE SPECIFICALLY REGULATED TO ONLY BE ALLOWED IN RESIDENTIAL ZONES.

UM, BUT YOU CAN'T HAVE YOUR DOG AND CATS AT YOUR CARETAKERS UNIT IN A COMMERCIAL OR INDUSTRIAL ZONE.

UM, OUR UNDERSTANDING IS THAT THE STATE DID ALLOW FOR FOLKS WHO, UM, TO SLEEP IN THEIR CARS OR RVS IF IT'S PARKED, PARKED IN THE PUBLIC RIGHT AWAY, BUT NOT, BUT, UM, NOTHING HAS COME DOWN FROM THE STATE THAT PROHIBITS LOCAL LEVEL FROM PROHIBITING SUCH HABITATION IN AN RV OR TRAILER.

MAYBE WE'LL JUST GET A MENTION, OH, WELL, SOME THINGS THAT LIKE SPENCER WAS THIS POINTING OUT TO ME IS THAT THE ZONING CODE CURRENTLY DOES ALLOW FOR A EMERGENCY HOUSING OPERATION ON SELECT SLOT SITES THAT QUALIFY.

SO THE PLANNING COMMISSION MAY REMEMBER THAT IT WAS JUST A FEW YEARS AGO THAT YOU MADE A RECOMMENDATION TO CITY COUNCIL TO ALLOW FOR EMERGENCY HOUSING ON SELECT SITES THAT MAY MET CERTAIN CRITERIA.

SO, UM, AND, AND WITH THAT, AND, UM, THE PROPERTY OWNER IN COMBINATION WITH A SERVICE PROVIDER CAN APPLY FOR A BUILDING PERMITS IF THEY WISH TO BUILD EMERGENCY SLEEPING CABINS, WHICH IS ALLOWED UNDER THE CALIFORNIA BUILDING CODE APPENDIX.

OH, SO YOU DO HAVE TO MEET STANDARDS OF SPECIFIC HABITABILITY.

SO THE ZONING CODE DOES PROVIDE FOR EMERGENCY HOUSING IN THOSE TWO FORMS ON W I BELIEVE WE IDENTIFIED 15 PROPERTIES ACROSS THE CITY.

AND SO FAR, NONE HAVE TAKEN ADVANTAGE OF THAT, EXCEPT FOR MERIDIAN BAPTIST CHURCH HAS GONE AS FAR AS HAVING PLANS, UM, PREPARED TO OBTAIN BUILDING PERMITS FOR THESE EMERGENCY SLEEPING CABINS.
