THE APPLICANT IS JEFF WHITTAKER.

UM, AND I BELIEVE HE IS ATTENDING IN ATTENDANCE AT THE MEETINGS.

SO LATER ON DURING THE PUBLIC HEARING, UM, HE CAN BE CALLED UPON.

YEAH, SO IT IS AN EXISTING BREWERY LOCATED AT SEVEN 85 VERNON WAY WITH AN ON SALE TYPE 23 BREWERY LICENSE.

UM, IT IS, UH, AN ALLOWED USE BY RIGHT PER ZONING CODE.

SO THEY DO NOT HAVE A USE PERMIT CURRENTLY FOR THE BREWERY.

THE BREWERY ALSO HAS A TASTING ROOM THAT'S IN LINE WITH OUR DEVELOPMENT STANDARDS.

UM, AND THE BREWERY DOES, UM, LIST AND THEIR PROJECT DESCRIPTION THAT THEY DO OPERATE BETWEEN THE HOURS OF 9:00 AM TO 9:00 PM DAILY.

UM, OBVIOUSLY THAT'S PROBABLY DURING IDEAL CONDITIONS, NOT DURING COVID.

UM, AND THERE MAY BE SOME TEMPORARY RESTRICTIONS ON THIS PARTICULAR USE.

UM, BUT THE CUP WOULD BE FOR LONG-TERM USE OF THE PROPERTY.

YEAH, THE GENERAL PLAN DESIGNATION FOR THIS PROPERTY IS INDUSTRIAL PARK AND IT IS IN THE MANUFACTURING ZONE.

UM, THE CUP IS FOR THE RESTAURANT USE, NOT FOR THE BREWERY.

UM, WE ONLY ALLOW RESTAURANTS IN VERY LIMITED CIRCUMSTANCES WITHIN OUR INDUSTRIAL ZONE.

AND ONE OF THOSE ALLOWED USES IS AS AN ACCESSORY TO A BREWERY OR OTHER ALCOHOL BEVERAGE PRODUCTION USE.

THIS IS THE SITE HERE AT SEVEN 85 VERNON WHITE, UM, AND THEY OCCUPY A PORTION OF THIS BUILDING.

UM, THE, THERE ARE SOME ADDITIONAL BUILDINGS ONSITE AND YOU'LL SEE IN THE SITE PLAN A FEW MINUTES THAT THEY DO SHARE PARKING AMONGST ALL THE VARIOUS USES AT THE SITE.

THIS IS THEIR PROPOSED FLOOR PLAN DEPICTING THE EXISTING BREWERY.

UM, WITH THE TASTING ROOM, THEY WOULD BE LOCATING A NEW KITCHEN WITHIN THE EXISTING BUILDING, UM, THAT WOULD PROVIDE FOOD SERVICE TO THE TASTING ROOM, UM, FOR CONSUMPTION, YOU KNOW, ALONG WITH ON SALE.

UM, YEAH, EXCUSE ME.

THIS IS THE SITE PLAN THAT DEPICTS THEIR TENANTS SPACE, AS WELL AS PARKING THROUGHOUT THE SITE.

THEY ARE ABLE TO PROVIDE PARKING NOT ONLY FOR THE EXISTING MANUFACTURING USES, BUT FOR THE MORE INTENSIVE PARKING REQUIREMENTS FOR OUR RESTAURANT USE AS WELL.

UM, THEY HAVE 60 PARKING SPACES AVAILABLE ON SITE FOR ALL OF THE USES.

THERE'S ALSO, UM, THE, THE ABILITY FOR, UH, MORE OF A SHARED PARKING AGREEMENT AS THE BREWERY OPERATES IN THE EVENINGS.

PRIMARILY THAT'S WHEN OUR BUSY TIME IS WHEREAS THE REST OF THE INDUSTRIAL BUILDINGS, UM, THEY USES AS QUITE CALMED DOWN BY THAT POINT, THEY ARE PROPOSING A NEW TRASH ENCLOSURE AS WELL.

I SHOULD POINT OUT ON THE SITE PLAN, UM, JUST, JUST TO THE SOUTH OF THE BUILDING AND JASON TO THE, THE OTHER BUILDING ON SITE.

GREAT.

IN TERMS OF LAND USE, UM, THIS, THE PRIMARY USE OF THE SITE OR OF THIS TENANT SPACE WOULD CONTINUE AS BEER MANUFACTURING AS IT CURRENTLY DOES TODAY.

UM, THEY WOULD JUST BE ADDING THIS ACCESSORY ON SELL FOOD SERVICE TO PROVIDE TO THEIR, YOU KNOW, CLIENTS AND PATRONS AS AN ADDITIONAL ENHANCEMENT OR BENEFIT.

THERE'S NO EXPANSION PROPOSED TO THE BUILDING.

THE ONLY MINOR MODIFICATIONS REALLY ARE THE INTERIOR TENANT IMPROVEMENTS NEEDED FOR THE KITCHEN, AS WELL AS THAT TRASH ENCLOSURE THAT I MENTIONED PREVIOUSLY, THEY CAN PROVIDE PARKING ONSITE TO MEET THE NEEDS OF THE INDUSTRIAL TENANTS, AS WELL AS THE BREWERY, UM,

AND POTENTIALLY, UH, THE HEIGHTENED DEMAND WITH HAVING AN ACCESSORY RESTAURANT.

AND THERE IS NO HISTORY OF REPORTED USES OR ISSUES, UM, EITHER POLICE DEPARTMENT ISSUES OR THEIR CODE COMPLIANCE CASE ISSUES.

UM, WE'VE HAD REALLY NONE, UM, NO SIGNIFICANT ISSUES WITH THE BREWERY SINCE IT'S BEEN AN OPERATION FOR THE LAST FEW YEARS.

SO FOR THOSE REASONS, STAFF IS RECOMMENDING THAT YOU ADOPT THE NEXT RESOLUTIONS IN ORDER APPROVING THE SECRET EXEMPTION AND CONDITIONAL USE PERMIT NUMBER 2020 DASH ZERO ZERO ONE TWO SUBJECT TO THE CONDITIONS IN THE DRAFT RESOLUTION OF APPROVAL.

UM, AND I SHOULD NOTE, UH, DIDN'T MENTION EARLIER THIS A CUP REQUEST FOR A RESTAURANT AT THIS PARTICULAR LOCATION WAS REVIEWED AND APPROVED BY THE PLANNING COMMISSION, UH, BACK IN 2018.

AND UNFORTUNATELY THE APPLICANT WAS NOT ABLE TO THAT PERMIT, UM, WITHIN THE EXPIRATION DATE.

SO IT DID EXPIRE, UM, BUT HE IS NOW READY TO MOVE FORWARD WITH THE RESTAURANT.

AND WHAT THIS DOES IS THIS ALLOWS STAFF TO STUDY AND PREPARE A DRAFT ORDINANCE TO RETURN TO YOU AT A LATER DATE FOR YOUR RECOMMENDATION FOR CITY COUNCIL.

AND I WILL BRIEFLY GO OVER SOME OF THE ITEMS THAT WE'RE PROPOSING TO INCLUDE WITHIN THE 2021 ZONING CODE UPDATE.

UM, THE FIRST IS A SET OF ECONOMIC DEVELOPMENT, UM, INCENTIVES OR INITIATIVES.

UM, FOOD TRUCKS IN TERMS OF THEIR PERMITTING PROCESS, TO LOOK AT EXPANDING THE TYPES OF BUSINESSES THAT CAN OPERATE FROM HOMES AND RESIDENCES TO ALLOW FOR SOME ADAPTIVE REUSE OF VACANT OR UNDERUTILIZED BUILDINGS, AND TO CONSIDER RELAXING PARKING STANDARDS FOR CHANGES IN USE, AND ALSO TO EVALUATE OUR APPROVAL PROCESSES AND MINIMIZE THE NUMBER OF DISCRETIONARY APPROVALS THAT ARE REQUIRED FOR LAND USE AND DEVELOPMENT.

THE SECOND HALF OF OUR ZONING CODE AMENDMENT WILL ADDRESS PRIMARILY HOUSING.

AND THERE ARE SEVERAL ITEMS HERE THAT WE'RE GOING TO BE LOOKING AT.

ONE IS THE FIRST IS THAT WE NEED TO COMPREHENSIVELY UPDATE OUR ACCESSORY DWELLING UNIT OR GRANNY FLAT ORDINANCE.

UM, THERE'S WERE A NUMBER OF STATE LAWS THAT WENT INTO EFFECT AT THE BEGINNING OF LAST YEAR.

UM, AND THE STATE IS, HAS ISSUED SOME GUIDANCE AND HOW TO INTERPRET THOSE.

SO WE NEED TO UPDATE TO COMPLY.

WE ARE CURRENTLY IMPLEMENTING THE STATE LAW, UM, AS APPLICABLE.

SO WE ARE IN COMPLIANCE, BUT WE DO NEED TO UPDATE THAT TO CLARIFY, UH, WHAT THE STANDARDS ARE FOR EVERYONE.

WE'RE GOING TO BE ALSO MODERNIZING OUR RESIDENTIAL DEVELOPMENT STANDARDS AND CREATING SOME NEW OBJECTIVE DESIGN STANDARDS FOR RESIDENTIAL DEVELOPMENT.

UM, WE WERE ABLE TO APPLY FOR SOME OF THAT SB TWO FUNDING THAT THE STATE OFFERED, UM, AND WE WILL BE GETTING SOME ASSISTANCE FROM SOME, UM, YOU KNOW, PROFESSIONAL, UH, PROFESSIONALS IN THE, IN THE DESIGN INDUSTRY TO HELP US CRAFT THOSE THERE.

SOME OTHER ITEMS RELATED TO OUR HOUSING ELEMENT AS WELL.

UM, WE'LL BE UPDATING SOME OF OUR STANDARDS IN IT AROUND TRANSITIONAL HOUSING, EMERGENCY SHELTERS, AND ALSO UPDATING, UH, MAKING SOME CHANGES TO OUR AFFORDABLE HOUSING DENSITY BONUS ORDINANCE.

SO THERE MAY BE A FEW OTHER MINOR CHANGES THAT I HAVEN'T COVERED THAT MAY BE BROUGHT FORWARD.

WE DO ON AN ANNUAL BASIS, ALWAYS KEEP A RUNNING LIST OF CHANGES THAT NEED TO BE MADE TO JUST PROVIDE CLARITY IN OUR ZONING CODE OR KIND OF KEEP UP TO DATE WITH WHAT THE CHANGING TIMES.

SO WE SHOULD EXPECT TO SEE SOME OTHER MINOR CHANGES AS WELL.

SO OUR REQUEST IS THAT THE PLANNING COMMISSION WOULD ADOPT THE NEXT RESOLUTION IN ORDER APPROVING THE ZONING CODE AMENDMENT INITIATION.

SO, UM, I'VE NOTICED THAT SOME OF THE PLACES WHERE IT'S POSSIBLE TO MAYBE PUT AN ADU OVER A GARAGE THAT WE'RE HAVING SOME HEIGHT LIMITATION ISSUES IN CERTAIN ZONES.

ARE YOU GOING TO BE LOOKING AT MAYBE CHANGING THAT A LITTLE BIT? UM, BECAUSE THE 20 FOOT OR 21 FOOT HEIGHT LIMITATION, MATE'S A DIFFICULT, UM, IS THAT SOMETHING THAT MIGHT BE LOOKED AT? UM, IT'S A POSSIBILITY.

I KNOW THAT WHEN WE TOOK THE LAST ORDINANCE AMENDMENT TO CITY COUNCIL, THERE WAS CONCERN ABOUT THE POTENTIAL FOR PRIVACY ISSUES.

UM, AND NOW WE HAVE TO CONSIDER THE FACT THAT ADU CAN NOW BE AS CLOSE AS FOUR FEET TO REAR INSIDE PROPERTY LINES.

SO THE HIGHER THAT WE ALLOW FOR THEM TO BE THE MORE THAT I GUESS THAT COULD BECOME AN ISSUE, RIGHT? I'M JUST, I'M, I'M, I'M TRYING TO GET AWAY FROM MOST, UH, PROPERTIES NOW ARE NINE FOOT TO THE CEILING.

AND ALCOHOL SEEMS TO HAVE A LOT OF EIGHT FOOT TO THE CEILING JUST TO MEET THOSE REQUIREMENTS LESS THAN THE RIGIDITY OF THE FLOOR.

INSTEAD OF PUTTING A 14 INCH JOYCE, WE'RE PUTTING NINE AND A HALF INCH, JOYCE JUST GIVES US A LOT OF, KIND OF CHEAP BUILDING CONSTRUCTION AND THEN HAVING A, SUCH A LOW PITCHED ROOF DOES NOT LOOK VERY ELEGANT.

AND SOME OF THE HISTORICAL BUILDINGS THAT WE HAVE ARE SO PRETTY WITH THEIR HIGHER PITCH ROOFS, YOU KNOW, SO I, I WOULD JUST LIKE TO HAVE STAFF KIND OF TAKE A LOOK AT WHAT MAYBE MIGHT HAVE BE IN THE, IN THE LOOP.

TRANSITIONAL HOUSING IS INTENDED TO PROVIDE SERVICES, TO HELP PEOPLE WHO ARE TRANSITIONING POTENTIALLY OUT OF HOMELESSNESS OR, OR NEED SOME WRAPAROUND SERVICES.

UM, SO THE TRANSITIONAL HOUSING PART OF IT IS THE, UM, IS THAT WE NEED TO UPDATE SOME OF THE STANDARDS THAT WE CURRENTLY HAVE IN THE CODE TO COMPLY WITH STATE LAW.

UM, BUT ON THE SIDE OF DOING MORE, UH, SORROWS, UM, I, I THINK THAT THERE'S A POSSIBILITY IN THE FUTURE TO DO MORE ESCROWS.

I THINK THE ONES THAT WE'VE DONE THE THREE SO FAR, I'VE BEEN FAIRLY SUCCESSFUL.

SO I THINK THAT'S ANOTHER OPTION.
